This year again, patent attorneys Jochen Ehlers and Dr. Till Augustin have published their article, “Recent Case Law of the EPO Boards of Appeal – Practical Notes”, in Mitteilungen der deutschen Patentanwälte.
The article provides an overview of the case law of the Boards of Appeal of the European Patent Office (EPO) during the reporting period from May 2025 to May 2026. It focuses on the Enlarged Board of Appeal decisions G 1/24 (claim interpretation), G 1/23 (prior art relating to commercially available products), and G 2/24 (the status of the intervener), as well as the pending referral G 1/25 (adaptation of the description).
