In the current issue of GRUR Patent, patent attorney Stefan Wiethoff discusses two decisions of the UPC Court of Appeal dated 9 January 2025 (UPC CoA 480/2024, UPC CoA 481/2024, Abbott v Sibio et al).
The decisions deal with access to UPC court files after the conclusion of the respective proceedings and confirm that members of the public are generally entitled to access the files of concluded proceedings even if they have no particular interest in them.
According to the new decisions, this also applies if the contents of the files are or may be the subject of further proceedings, for example because an appeal is pending or because the proceedings concern interim measures. The decisions thus strengthen the UPC's principle of transparency and facilitate public access to court files after the proceedings have ended.
