In the current issue of the "Mitteilungen der deutschen Patentanwälte", patent attorney Dr Christine Cirl and attorneys-at-law Sönke Scheltz and Dr Michael Schneider have published an article entitled "Inescapable Opt-out-Trap? Scope of the blocking effect of former national proceedings with regard to the withdrawal of an opt-out of the exclusive competence of the Unified Patent Court (UPC)".
The article deals with the scope of blocking effects of national proceedings on opt-outs and their withdrawal (opt-in) before the Unified Patent Court. Based on the current UPCA guidelines and various scenarios, possible courses of action and pitfalls for patent owners and applicants are discussed.
